MATANGI STATION MTB PASS - TERMS & CONDITIONS / RISK DISCLOSURE

Matangi Station is private property. By ordering a Matangi Station MTB Pass and entering the park, you confirm that you have read and understood the following terms and conditions and that you will comply with the terms and be bound by them at all times while you are at the park.

ASSUMPTION OF RISK

You agree to assume the risk of any injury to your person or property resulting from the inherent dangers and risk of mountain biking in the park and may not recover from Matangi Station Limited, Matangi Station MTB Limited or any of its employees for any injury resulting from the inherent dangers of your activities within the park. Inherent dangers include, but are not limited to, slips, falls, trips, collisions with natural objects, man-made objects or other riders, hikers, domestic or wild animals, variations in terrain, and the failure of riders to ride within their own abilities. Other risks include changeable weather conditions, cliffs, steep and extreme terrain, jumps and drop-offs. For mountain biking, protective gear is highly recommended and riders must control speed and course at all times. It is also recommended that riders arrange insurance for their health and property before mountain biking in the park. All bikes must have a working front and rear brake. Visitors to the park agree to ASSUME ALL RISKS, inherent or otherwise, and RELEASES MATANGI STATION LIMITED, MATANGI STATION MTB LIMITED AND ITS EMPLOYEES FROM ANY LIABILITY for any loss, damage, expense, or injury that they or a third party may suffer resulting from their use of or presence at the park.

EMERGENCY TREATMENT

Subject to the clause above, if you require emergency medical treatment then you give your consent and permission to Matangi Station MTB Limited to provide medical assistance to you including, but not limited to, first aid, arranging treatment by medical personnel, physicians, nurses or paramedics, and to authorise any emergency treatment. You acknowledge that you must meet the costs of such emergency treatment.

YOUR OBLIGATIONS

All visitors must comply with the instructions of any employees and all posted signs. Remain alert to hazards and act in a careful and respectful manner at all times.

You must not engage in unacceptable behaviour while in the park. Unacceptable behaviour include (without limitation):

Smoking, vaping and/or consuming drugs or alcohol anywhere in the park.

Swearing or making excessive noise that disturbs other guests in the park.

Bringing animals in the park, other than areas where animals are allowed.

Harassing employees or owners of Matangi Station Limited, Matangi Station MTB Limited or other people in the park.

Visitors may be asked to leave the park and could have any access rights revoked if they engage in any unacceptable behaviour or any other conduct that is improper, dangerous or constitutes fraud or nuisance.

In addition to the above, when mountain biking in the park, YOU MUST:

Always wear a helmet at all times.

Supervise any riders in your group below the age of 15 or complete a parent/ guardian permission form for any said riders under the age of 15 for the season.

Ride within your limits in order to minimise risk of accident and injury to yourself and others in the park.

Always inspect structures before attempting them, never assume that an obstacle is the same as when you last rode it.

Ride unexplored trails slowly several times in order to gain a good understanding of conditions.

PAYMENT, CANCELLATIONS AND REFUNDS

PAYMENT TERMS: All prices quoted are in New Zealand dollars, include GST and are subject to change without notice.

All charges are payable in full at the time of purchase. Payments can only be made via Visa Debit, Visa and MasterCard.

CANCELLATIONS & REFUND

We reserve the right to cancel, delay or amend the hours of our operation or any of the passes for any reason.

All passes are strictly non-refundable and cannot be shared or transferred.

Marketing and Advertising

You acknowledge that Matangi Station MTB Limited may take photos or videos of events, activities, clinics or coaching sessions that you participate in and you give permission to Matangi Station MTB Limited to use any and all such materials for marketing, advertising, website, social media or other purposes.

PRIVACY POLICY

We value the privacy of all visitors to the park and take every step to ensure that your information remains confidential. Matangi Station MTB Limited does not collect private or personal information from you, except where you willingly provide it further to the clause above. If you contact us, we may keep a record of that correspondence.

Matangi Station MTB Limited will not disclose any of your personally identifiable information except when we have your permission.

By providing us with your email address you consent to receive emails from us advising of updates and services available. You may unsubscribe from our email database at any time.

You may edit any personal information that Matangi Station MTB Limited holds on you by contacting us via phone or email. Your information can be updated, corrected or deleted at your request at any time.

As with all information, Matangi Station MTB Limited will never rent or sell your personal information.

You acknowledge that no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Matangi Station MTB Limited cannot ensure or warrant the security of any information you transmit to us over the internet. Once we receive your transmission, we make our best effort to ensure its security on our systems.
